Conditions of Use


1. RETURN AND REFUND POLICY

Return and refund policy are regulated with Italian laws (Dlgs 114/98 e Directive 97/7/CE) where customer is a physical person that purchase goods for scopes that are out of their own professional activities. Those people have the right to return goods and to be refunded for any reason. In order to have this right, the customer should send a communication to ShopDiver a communication within 10 working days from the date when the good arrived to the destination specified by the customer during purchasing. Communication should be sent out using the module in “Contact us” page, providing all information related to the purchase/shipment completed.
Attention: Return and refund policy could not be applied for those who are not private people. Companies and professionals could not have this right.


How to apply withdrawal

Cooling off period is 10 working days long, in this period the customer should send a communication to ShopDiver where he/she would apply the return and refund policy.
There are some conditions that must be followed if the customer would enjoy this right:

The purchased good must be complete of all its parts in the original box (including package, documentation, manuals, cables, etc.);

Shipping is under the customer responsibility until it is delivered to our warehouse. ShopDiver is not responsible for any damage or if the goods are stolen during transport to the wharehouse, we strongly suggest to insure the shipment.


Goods redelivery to ShopDiver
Goods must have been delivered to ShopDiver within 14 days after communication.

Excepting eventual costs for damages to the original package, ShopDiver will refund the entire price of the product excluding shipment costs within 20 days from arrival of the goods to the warehouse. Refund will be done through Credit Card or Bank Transfer, in this last case it will be care of the customer to provide bank account details (IBAN).

When customer could not apply the return and refund policy
Return and Refund policy is not applicable when the good has lost the integrity (good itself or the package) in those cases where ShopDiver determines:
  • Use or partial use of the good;
  • Missing of the external box or original internal package;
  • Missing parts of the good (tools, cables, manuals, etc.);
  • Damages not caused by transport;
  • In all the above casese ShopDiver will ship back the goods to the customer charging the customer with the shipment costs.

    2. WARRANTEE

    All products sold by ShopDiver are covered with 24 months warrantee of the manufacturer of the product and with 24 months warrantee for any conformity defect (DL 24/02). In order to obtain warrantee assistance, customer must store the invoice and show it when required. By using the ShopDiver website, customers signify their agreement to be bound by these conditions. Manufacturer warranty conditions are provided following the process described with documentation present in the box when delivered. If, after a check up done by an Authorized Assistance Centre, it has been defined that the damage or conformity defect are not covered by the manufacturer warranty, customer will be charged of the incurred costs for verification done by the Authorized Assistance Centre and eventually also of the costs for shipment if supported by ShopDiver.


    24 months warrantee

    24 months warranty (DL 24/02) is applicable to the product that has a conformity defect as long as the product itself has been used in the right manner, following the correct process for using and the process described in the technical manuals. This warrantee is up to the private customer. In case of conformity defect ShopDiver will provide to the restore of the conformity of the product (repair, replacement, a special discount or annulment of the contract).
    Customer must contact ShopDiver using “Contact us” page in this web site providing all information, ShopDiver will contact customer in order to provide address and details for shipment. In the case it is not possible to repair or replace the product to the customer, ShopDive will proceed in two possible ways:

  • Refund completely the customer including all expenses;
  • Replace the product with something with the same or better features.
  • If, after a check up done by an Authorized Assistance Centre, it has been defined that the damage or conformity defect are not covered by the 24 months warranty, customer will be charged of the incurred costs for verification done by the Authorized Assistance Centre and eventually also of the costs for shipment if supported by ShopDiver.

    DOA (dead on arrival)

    Replacement in case of DOA could be peformed through ShopDiver that will be the point of contact of the customer. ShopDiver will apply the policy established by the manufacturer.
    In the case that shopDiver won’t be able to replace or repair the product, it will be at discrection of ShopDiver to refund completely the customer of the expenses incurred or replace the product with something with the same or better features.


    Timelines for replacement

    Timelines for replacement or repair of the product are defined exclusively by the manufacturer policies.

    Delays

    ShopDiver could not be charged of any eventual disservice due by manufacturer delays when repairing or replacing the products.


    Return

    In those cases where it has been defined that the product have to be returned to the manufacturer, customer must ship the product including all original parts (cables, manuals, documents, etc) of the product, including original package. In order to limit any further damage we strongly recommend to ship the entire original box in a new package.


    Applicable laws

    Sell contract between the customer and ShopDiver is completed in Italy and regulated by Italian laws.


    Assistance and Warrantee provided directly by ShopDiver

    ShopDiver will assist al clints providing helps and assistance acting as first point of contact for customers. ShopDiver will then act as interface with the manufacturer or will put in contact customer directly with manufacturer depending on the assistance agreement with manufacturer.

    All those goods delivered to ShopDiver without part of the product or of the packaging will be returned to the customer charging the customer of the incurred costs (shipment, etc). The same policy will be applied to the products shipped with not adequate packagiong that causes damages to the goods.

    ShopDiver won’t be responsible of data loss on supports or products that must be repaired or replaced.
    If product is tampered or serial codes have been removed or are not usable, ShopDiver will decide case by case if warranty could be applicable or not.

    In case of modification to the “Conditions of Use”, ShopDiver will apply conditions active in the moment the customer buys the product.


    3. IMAGES AND PRICES ON CATALOG

    Prices in catalog could ba changed without any previous advice. Images, pictures and characteristics are purely illustrative and couldn't reflect exactly the product. Shopdiver is ready to answer to all questions about details of goods available in the catalog.
